metromedya grants you a limited, non-exclusive, non-transferable, revocable license to use Direct Message for personal purposes in accordance with these Terms and the App Store terms.

2.1 Free Features

Direct Message provides core messaging features free of charge. Premium features may be available through in-app purchases or subscriptions.

3. User Responsibilities

You agree to:

  • Use the App in compliance with all applicable laws and regulations
  • Not reverse engineer, decompile, or disassemble the App
  • Not use the App for any unlawful or prohibited purpose
  • Not use the App for spam, harassment, or unsolicited messages
  • Respect intellectual property rights of the App and third-party services
  • Comply with WhatsApp's Terms of Service when using their platform

4. Third-Party Services

Direct Message integrates with WhatsApp for message delivery. Your use of WhatsApp is subject to their terms of service and privacy policies. We are not responsible for the availability, accuracy, or functionality of WhatsApp services.

5. Intellectual Property

The App, including its design, code, graphics, and documentation, is owned by metromedya and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

6. Privacy and Data

Your use of the App is also governed by our Privacy Policy. We collect minimal data and prioritize your privacy. Message templates are stored locally on your device. Please review our Privacy Policy for detailed information.

7. Disclaimers and Limitations of Liability

7.1 No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 Message Delivery

We do not guarantee the delivery of messages sent through WhatsApp. Message delivery depends on WhatsApp's services and the recipient's availability. You should not rely solely on this app for critical communications.

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, metromedya SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

8. Updates and Modifications

We may update, modify, or discontinue the App at any time without prior notice. We may also modify these Terms from time to time. Continued use of the App after changes constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.

9. Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including breach of these Terms. You may terminate your use of the App at any time by uninstalling it from your device.

10. System Requirements

Direct Message requires iOS 13.0 or later and a compatible iPhone. WhatsApp must be installed on your device for messaging features to work. We are not responsible if the App does not function on your device due to incompatible system specifications.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the App shall be resolved in the courts of Turkey.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
